1. Acceptance of Terms

Welcome to LANTITE Practice. By accessing or using our website and services at lantite.com.au (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and LANTITE Practice ("we," "us," or "our") regarding your use of the Service.

2. Description of Service

LANTITE Practice provides online test preparation materials for the Literacy and Numeracy Test for Initial Teacher Education (LANTITE). Our Service includes:

  • 260+ numeracy skills across multiple difficulty levels
  • 9 comprehensive literacy modules covering reading and writing components
  • AI-powered learning assistant (LISA)
  • Progress tracking and performance analytics
  • Interactive lessons, practice questions, and assessments

Important: LANTITE Practice is an independent test preparation service and is NOT affiliated with, endorsed by, or connected to ACER (Australian Council for Educational Research), the official provider of the LANTITE test.

3. Eligibility and Account Registration

To use our Service, you must:

  • Be at least 18 years old, or have parental/guardian consent if between 13-17 years old
  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

4.1 Subscription Plans

We offer monthly subscription plans with varying durations (1-month, 3-month, 6-month). All subscriptions provide full access to our numeracy or literacy content during the active subscription period.

4.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the then-current subscription fee for your plan.

4.3 Payment Processing

Payments are processed securely through Stripe, a third-party payment processor. We do not store your credit card information. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.4 Cancellation

You may cancel your subscription at any time from your profile page. Upon cancellation:

  • You will retain access until the end of your current billing period
  • Your subscription will not renew
  • No refunds will be provided for the unused portion of your subscription period

4.5 Refund Policy

We offer a 14-day money-back guarantee for first-time subscribers. If you are not satisfied with our Service, you may request a full refund within 14 days of your initial purchase by using the Contact Support button on your profile page.

After 14 days, subscriptions are non-refundable. However, refunds may be considered on a case-by-case basis for technical issues that prevent access to the Service.

4.6 Price Changes

We reserve the right to modify subscription prices. Price changes will not affect your current subscription period but will apply upon renewal. We will provide at least 30 days' notice of any price increases.

5. Intellectual Property Rights

All content on the Service, including but not limited to text, graphics, logos, questions, lessons, software, and other materials (the "Content"), is owned by LANTITE Practice and protected by Australian and international copyright laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Content solely for personal, non-commercial educational purposes during your active subscription period.

You may NOT:

  • Copy, reproduce, distribute, or publicly display any Content
  • Share your account credentials or access with others
  • Download, scrape, or extract Content from the Service
  • Create derivative works based on our Content
  • Use the Content for commercial purposes or resale
  • Remove any copyright or proprietary notices

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Share answers, solutions, or Content publicly (e.g., on forums, social media)
  • Use automated systems (bots, scrapers) to access the Service
  • Attempt to reverse engineer, decompile, or hack the Service
  • Create multiple accounts to bypass subscription limits
  • Impersonate another person or entity
  • Upload viruses, malware, or other harmful code
  • Interfere with or disrupt the Service or servers
  • Violate any applicable laws or regulations

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

7. Disclaimers and Limitations of Liability

7.1 "As Is" Service

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 Limitation of Liability

To the maximum extent permitted by Australian law, LANTITE Practice shall not be liable for:

  • Test failure or unsatisfactory test scores
  • Technical errors, interruptions, or data loss
  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities

In any case, our total liability to you shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

7.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, term, condition, right, or remedy implied or imposed by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted, or modified.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our privacy practices as described in the Privacy Policy.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Any reason we deem appropriate to protect our Service or other users

Upon termination:

  • Your right to access the Service immediately ceases
  • We may delete your account and all associated data
  • You remain liable for any outstanding fees
  • No refunds will be provided for prepaid subscription periods

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Notify you via email or through a prominent notice on the Service
  • Provide at least 30 days' notice before changes take effect

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must cancel your subscription.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Australia.

Before initiating any legal action, you agree to first attempt to resolve the dispute informally by contacting us through the Contact Support button on your profile page.

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LANTITE Practice regarding the Service.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your account to any third party without our written consent. We may assign these Terms without restriction.
